TERMS OF SERVICE

GENERAL

By clicking "I Agree to the Terms of Service" and submitting any form on this site, the Client confirms that all information provided is true and correct, and agrees to the following terms regarding services provided by Tyler Coleman (DBA TY PIERCE Photography).

DEPOSIT & PAYMENT

A deposit is required to secure a session and will be applied toward the total session cost. The remaining balance is due on or before the date of the session. No images will be delivered until payment is made in full. Deposits are non-refundable.

CANCELLATION & RESCHEDULING

If the Client must cancel a session, the Client has 30 days from the original session date to reschedule, subject to availability, without forfeiting the deposit. If the rescheduled session falls outside the 30-day window, a new deposit will be required.

SPECIAL REQUESTS

Requests outside the standard scope of service — including but not limited to additional, advanced, or extensive retouching, custom file formats, expedited delivery, or specific editing styles — may result in additional charges and/or extended turnaround times. All special requests must be submitted in writing and approved in advance. TY PIERCE Photography reserves the right to accept, modify, or decline such requests based on feasibility and scheduling.

LATE ARRIVAL

Clients arriving more than 15 minutes late may have their session shortened or rescheduled at the discretion of TY PIERCE Photography. Rescheduling due to tardiness may require a new deposit.

GUARANTEES

TY PIERCE Photography does not guarantee any specific result. Tools such as tethered shooting are utilized to help ensure high-quality images. Clients will have the opportunity to review photos during their session and provide feedback. If the final images are deemed by mutual agreement to be objectively unusable, TY PIERCE Photography will offer one complimentary re-shoot, which must occur within 14 days of the original session date, subject to availability. Requesting a re-shoot forfeits any access or rights to images from the original session.

DELIVERY TIMELINE

Final retouched images are typically delivered within 7–10 business days after selections are submitted. Turnaround times may vary depending on workload, special requests, or holidays. Expedited delivery may be available for an additional fee and must be arranged in advance.

HEADSHOT DELIVERABLES

Clients will receive an interactive proofing gallery with watermarked images to select their retouch choices. Each package includes a limited number of professionally retouched images. Once selections are submitted, the gallery will lock and no further favorites, selections, or changes can be made. Additional retouched and licensed images may be purchased separately. Original, unretouched images are not included but may be purchased separately as outlined on the Rates page.

CLIENT PAGE & PROOFING GALLERY USE

Each client will receive access to a private, password-protected webpage and interactive proofing gallery hosted on TY PIERCE Photography’s server. This gallery is intended solely for image review and selection. By accessing the gallery, the Client agrees not to screenshot, download, or share unlicensed or watermarked images. All galleries are temporary and may be removed at any time after the delivery period has expired. Sharing gallery access with third parties does not transfer image usage rights or licenses.

PRODUCT PHOTO DELIVERABLES

Clients will receive an interactive proofing gallery with watermarked images to select retouch choices. Depending on the scope of the project, the gallery may include a limited or unlimited number of selectable images. Once selections are submitted, the gallery will lock and no further favorites, selections, or changes can be made. Additional retouched and licensed images may be purchased separately. Original, unretouched images are not included.

REVISIONS

Each retouched headshot includes one round of minor revisions (e.g., blemish removal, flyaway reduction). Additional or extensive revisions may incur additional fees. Revision requests must be submitted within 5 business days of final image delivery.

IMAGE SELECTION DEADLINE

Image selections must be made within 7 days of receiving the proofing gallery. If no selections are submitted, TY PIERCE Photography will choose images for retouching. If the Client is unsatisfied with those selections, additional retouches may be purchased for an added fee as outlined on the Rates page.

FILE STORAGE POLICY

Proofing galleries and final retouched images will remain available for download for a minimum of 30 days after delivery. Galleries, download links, ZIP files, and any related files may be temporarily or permanently deleted at the sole discretion of TY PIERCE Photography. TY PIERCE Photography is not responsible for archiving, backing up, or storing images beyond this period unless otherwise agreed in writing. Files may be requested for re-download, subject to availability, timing, work load, and other factors. Repeated requests for re-uploads may incur additional fees.

IMAGE USAGE RIGHTS

Headshot clients receive a non-commercial, non-transferable license to use delivered images for personal and professional purposes. Use of images for commercial advertising, resale, or by third parties requires separate licensing. TY PIERCE Photography retains full copyright to all images unless otherwise agreed. Commercial clients retain commercial licensing as outlined in the agreement.

COMMERCIAL USAGE & LICENSING

Product photography clients receive a non-exclusive, perpetual, worldwide commercial license to use final delivered images for marketing, advertising, social media, websites, and print materials. This license does not include resale, sublicensing, or transfer to third parties without written permission. TY PIERCE Photography retains copyright to all images unless otherwise agreed in writing. Licensing applies only to final, retouched images.

PROHIBITED USES

Client agrees not to use any images for unlawful purposes or in connection with training artificial intelligence models, deepfakes, NFTs, or other unauthorized derivative works without written consent. All image use must comply with the licensing terms outlined in this agreement.

LIMITATION OF LIABILITY

In the event of equipment failure, illness, accident, or any other unforeseen disruption that prevents the session or delivery of images, TY PIERCE Photography’s liability is limited to rescheduling the session or refunding any payments made. TY PIERCE Photography is not responsible for consequential damages or Client expenses resulting from a missed or rescheduled session.
